1. Introduction and Acceptance
The Service is intended for users located in the Republic of Moldova.
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.
2. Definitions
- User (“you”, “your”) — a natural person who has registered an account in the App and uses the Service to discover and purchase Offers.
- Partner — a restaurant, café, bakery, shop, or any other business that publishes Offers in the App.
- Offer — a product or set of products (including “surprise” packages with undisclosed contents) made available by a Partner via the App at a reduced price.
- Order — a confirmed purchase of an Offer by the User from a Partner through the App.
- Pickup Window — the time interval set by the Partner during which the User must collect the Order.
3. Eligibility
To use the Service, you must:
- be at least 16 years of age;
- have the legal capacity to enter into a binding agreement;
- be located in the Republic of Moldova at the time of using the Service;
- provide accurate, current, and complete information when registering.
If you are between 16 and 18, you confirm that your parent or legal guardian has consented to your use of the Service and to these Terms.
4. Nature of the Service: GustViu’s Role
GustViu is a technology platform that connects Users with Partners offering food and other products at a reduced price, often as a means of reducing surplus and food waste.
WEBNUM LLC acts solely as an intermediary. When you place an Order:
- the sales contract is concluded directly between you and the Partner;
- the Partner is solely responsible for the quality, quantity, composition, freshness, hygiene, packaging, labelling, and delivery of the products;
- WEBNUM LLC is not a party to that contract and does not own, prepare, store, or sell the products.
The Operator’s role is limited to providing the technical infrastructure: displaying Offers, processing reservations and payments, sending notifications, and providing customer support concerning the platform itself.
5. Account Registration
To place Orders, you must create an account by providing your name, email, phone number, and a password — or by signing in via Apple ID or Google.
You agree to:
- keep your account credentials confidential;
- notify us immediately at info@webnum.com of any unauthorized use of your account;
- be responsible for all activity carried out through your account.
We reserve the right to refuse registration, suspend, or terminate any account at our reasonable discretion, particularly in cases of fraud, abuse, or breach of these Terms.
6. Offers, Orders, and Pickup
6.1. Offer Information
Partners are responsible for the accuracy of the information they publish (description, price, ingredients, allergens, pickup window, etc.). The Operator does not verify each Offer individually and is not liable for inaccuracies provided by Partners.
6.2. Surprise Packages
Some Offers may be sold as surprise packages: the exact contents are not disclosed in advance. By purchasing such an Offer, you accept that the contents are determined by the Partner based on the surplus available at the moment of pickup. The contents may vary and the Operator makes no representation as to specific items.
6.3. Placing an Order
A confirmed Order in the App constitutes a binding purchase. Once payment is processed, you receive a digital order confirmation that must be presented to the Partner at pickup.
6.4. Pickup
You must collect your Order within the Pickup Window specified by the Partner.
- If you fail to collect the Order within the Pickup Window, the Order is considered fulfilled and no refund is due.
- You are responsible for arriving on time, presenting your order confirmation, and verifying the contents at pickup.
- The Partner may refuse to hand over an Order if the order confirmation cannot be presented or if there are reasonable grounds to doubt the User’s identity (e.g., for age-restricted products).
6.5. Age-Restricted Products
If an Offer includes alcohol, tobacco, or other age-restricted products, the Partner is required to verify your age at pickup. The Partner may refuse delivery if proper identification is not provided, in which case the corresponding portion of the Order is not refundable.
7. Pricing, Payment, and Taxes
All prices are displayed in Moldovan Lei (MDL) and include applicable VAT, unless stated otherwise.
Payment is processed through certified payment providers integrated into the App. The Operator does not store full card details.
Receipts (fiscal documents) are issued by the Partner in accordance with Moldovan law.
We reserve the right to correct obvious pricing errors. If a pricing error is detected before pickup, the affected Order may be cancelled and refunded in full.
8. Cancellation and Refunds
8.1. Cancellation by the User
Once an Order is confirmed and paid, it generally cannot be cancelled or refunded, because the Offers concern perishable food prepared specifically for the Pickup Window. This is consistent with the consumer protection exception for goods that may deteriorate quickly.
8.2. Cancellation by the Partner
If the Partner cannot fulfil your Order (for example, the Offer ran out, the Partner is closed unexpectedly, or the Pickup Window cannot be honoured), the Order will be cancelled and you will receive a full refund to your original payment method within a reasonable period.
8.3. Quality Issues
If the product you receive is materially different from the Offer description, spoiled, or otherwise non-conforming, contact us at info@webnum.com within 24 hours after pickup, attaching photos and a brief description. We will mediate between you and the Partner. Refunds for quality issues are funded by the Partner; the Operator does not guarantee the outcome of such disputes but will act in good faith.
9. Food Safety, Allergens, and User Responsibility
You acknowledge and agree that:
- products sold through the App are often surplus food and may have a shorter shelf life; you should consume them promptly after pickup and follow any storage instructions provided by the Partner;
- you are responsible for checking ingredient and allergen information made available by the Partner before purchase;
- if you have allergies or specific dietary requirements (gluten-free, halal, kosher, vegan, etc.), you must contact the Partner directly to confirm suitability before placing an Order, especially for surprise packages where contents are not disclosed in advance;
- the Operator is not liable for any allergic reactions, intolerances, or other adverse health effects caused by products supplied by Partners.
10. User Conduct and Prohibited Use
You agree not to:
- provide false, misleading, or fraudulent information;
- use the Service for any unlawful purpose or in violation of Moldovan law;
- create multiple accounts to abuse promotions, discounts, or referral programs;
- resell, redistribute, or commercially exploit Offers obtained through the App;
- interfere with the operation of the App, attempt to access it through unauthorized means, reverse-engineer, decompile, or modify it;
- harass, threaten, or defame Partners, their staff, other Users, or our employees;
- post reviews that are knowingly false, defamatory, or that contain offensive language;
- upload viruses, malicious code, or attempt to compromise the security of the Service.
Violation of these provisions may result in suspension or termination of your account and, where applicable, civil or criminal liability.
11. Reviews and User Content
You may submit reviews, ratings, photos, and comments (“User Content”) about Partners and Offers.
By submitting User Content, you:
- represent that you have the right to do so and that the content is truthful and based on your actual experience;
- grant the Operator a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, modify, and distribute such content in connection with the Service and our marketing activities;
- agree that we may, at our reasonable discretion, remove or refuse to publish content that violates these Terms or applicable law.
You retain ownership of your User Content but understand that we cannot guarantee its permanent storage.
12. Intellectual Property
All elements of the Service — including the GustViu name, logo, design, source code, graphics, text, illustrations, and databases — are the exclusive property of WEBNUM LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. Any other use requires our prior written consent.
13. Disclaimers and Limitation of Liability
13.1. “As Is” Basis
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
13.2. No Liability for Partners
The Operator is not responsible for:
- the quality, safety, freshness, or legal compliance of products supplied by Partners;
- the actions, omissions, statements, or representations of Partners;
- delays, closures, or failures by Partners to honour Pickup Windows.
13.3. Limitation of Liability
To the maximum extent permitted by Moldovan law, the Operator’s total aggregate liability arising out of or in connection with the Service shall not exceed the amount you paid through the App during the twelve (12) months preceding the event giving rise to the claim.
The Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity.
Nothing in these Terms limits liability that cannot be limited under applicable law (including liability for gross negligence, wilful misconduct, or harm to life and health).
14. Indemnification
You agree to indemnify and hold harmless WEBNUM LLC, its directors, employees, and contractors from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of:
- your breach of these Terms;
- your violation of any law or third-party right;
- User Content you submit through the Service;
- your misuse of the Service.
15. Suspension and Termination
We may suspend or terminate your access to the Service, with or without notice, if:
- you breach these Terms;
- we reasonably suspect fraudulent, abusive, or illegal activity;
- it is required by law or by a competent authority;
- the Operator decides to discontinue the Service in whole or in part.
You may terminate your account at any time through the App (Profile → Settings → Delete Account) or by contacting info@webnum.com. Termination does not affect Orders already placed or rights and obligations that have accrued before termination.
16. Force Majeure
The Operator shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, epidemics, war, civil unrest, strikes, government actions, internet or power outages, or failures of third-party services.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Moldova, without regard to conflict-of-law rules.
We aim to resolve disputes amicably. If you have a complaint, please contact us at info@webnum.com before initiating any legal proceedings. We will endeavour to respond within 30 calendar days.
If the dispute cannot be resolved amicably, it shall be submitted to the competent courts of the Republic of Moldova, in the city of Chișinău, unless otherwise required by mandatory consumer protection laws granting consumers the right to bring proceedings in their place of residence.
Consumers may also use the official complaint mechanisms of:
- the Consumer Protection and Market Surveillance Agency of the Republic of Moldova (Agenția pentru Protecția Consumatorilor și Supravegherea Pieței);
- the National Center for Personal Data Protection of the Republic of Moldova (CNPDCP) for personal data matters.
18. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the App and/or by email at least 14 days before they take effect. The most current version is always available at a permanent link within the App.
Continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree, you must stop using the Service and may delete your account.
19. Miscellaneous
- Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Operator regarding the Service.
- Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- No Waiver. Failure by the Operator to enforce any provision shall not constitute a waiver of that provision.
- Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. The Operator may assign these Terms in the context of a merger, acquisition, or business reorganization.
- Headings. Section headings are for convenience only and do not affect interpretation.
- Languages. These Terms may be made available in multiple languages. In case of discrepancy between versions, the English version shall prevail, except where mandatory Moldovan law requires otherwise.
